**A ₹500,000.00 crypto gain costs ₹156,000.00 in tax in India, 31.2% of the gain, whatever your income below ₹5,000,000 (tax year 2026-27).**

Tax on a crypto sale in India for tax year 2026-27: a flat 30.0% plus 4.0% cess on the gain, and a surcharge on high incomes.

## Formula

```text
gain       = sale proceeds − cost of acquisition (no other deduction; whether a fee paid to buy counts toward that cost is unsettled)
tax        = gain × 30.0%
surcharge  = on the tax once total income passes ₹5,000,000, with marginal relief
cess       = 4.0% of tax plus surcharge
```

Section 115BBH of the 1961 Act, carried into the Income-tax Act, 2025, sets the flat rate. Surcharge tiers: 10.0% above ₹5,000,000, 15.0% above ₹10,000,000, 25.0% above ₹20,000,000. How long you held the coin changes nothing, and a crypto loss cannot be set off against any other income.
